American Disabilities Act (ADA) and Gender Dysphoria

Last year, the Court of Appeals for the Fourth Circuit ruled that gender dysphoria may be protected as a disability under federal disability discrimination law. In William v. Kincaid (August 16, 2022), the Fourth Circuit ruled that gender dysphoria is a covered disability under the Americans with Disabilities Act (ADA). This INSIGHTS piece recently authored by Of Counsel, Ruofei Xiang details that this case continues to have broad implications for employers across the country and that the Court’s ruling should serve as a reminder for employers to be proactive in monitoring workplace practices and policy revisions.
